1. This agreement
These Terms of Service (“Terms”) are a legal agreement between you and Mythria Studios, LLC (“we”, “us” or “our”). They cover Mythria: the game, the Mythria launcher, our websites including mythria.online, your account, the in-game shop, our emails and any related services (together, the “Services”).
By creating an account, signing in, installing or playing Mythria, or buying anything from us, you agree to these Terms and to the documents they include: the End User License Agreement for the software, the Privacy Policy and the Code of Conduct. If you don’t agree, don’t use the Services.
Please note: section 17 requires most disputes to be resolved by individual binding arbitration instead of in court, and waives class actions and jury trials. You can opt out within 30 days, as section 17 explains.
2. Who can use Mythria
- You must be at least 13 years old to create an account or use the game. We ask for your date of birth before an account is created, and we don’t knowingly let anyone under 13 use the Services. If we learn an account belongs to someone under 13, we’ll close it and delete its personal information.
- If you’re under 18, or under the age of majority where you live, a parent or legal guardian must review and agree to these Terms for you. They’re responsible for your use of the Services, including any purchases.
- You can’t use the Services if we’ve banned you before, or if the law doesn’t allow you to use them, for example under U.S. sanctions laws.
- During the closed alpha, playing also requires an invitation from us (section 4).
3. Your account
- Give us accurate information and keep your email address current. It’s how you sign in, receive sign-in codes and get important notices.
- Your account is for you alone. Don’t share, sell, lend or transfer it, don’t let anyone else use it, and don’t use anyone else’s.
- Keep your password and sign-in codes secret. You’re responsible for everything done through your account unless it happened because of our failure. Tell us right away at support@mythria.online if you think someone else has used it.
- Your account and what’s in it, such as characters, names, items, gold, Mythria Points and unlocks, are part of the Services. You have a license to use them under these Terms, but you don’t own them, and they have no value outside Mythria.
- We may refuse or change a character, guild or account name that breaks the Code of Conduct or infringes someone’s rights.
- You can close your account at any time by emailing us from its email address. Closing it ends your access, and anything left in it, including unused Mythria Points, is lost unless the law requires otherwise.
4. Closed alpha and test versions
Mythria is in development. It’s currently a closed alpha that you can join only by invitation, and test versions may be incomplete, unstable or sometimes unavailable.
- We may reset, change or remove characters, items, gold, progress and other game data during testing or when the game launches. We’ll try to warn you first, but we can’t promise we always will.
- Invitation codes are personal. They’re tied to the email address we approved, and you may not share, sell or transfer them.
- Joining our email list or buying a pack doesn’t guarantee an invitation, and an invitation doesn’t guarantee access to later tests or releases.
- If you send us feedback, ideas or bug reports, we may use them as section 10 describes.
5. Using the game
Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable and revocable license to use the Services for your own non-commercial entertainment. The software you install is covered by the End User License Agreement. Everything else about Mythria, including its world, characters, art, music, text, code and trademarks, belongs to us or our licensors, and we keep all rights we don’t expressly give you.
We update Mythria often. Updates may add, change or remove features, content, items or game balance, and some updates must be installed before you can keep playing. The launcher installs required updates before it starts the game.
6. Rules of play
You must follow the Code of Conduct. In particular, you may not:
- cheat, or use bots, automation, hacks, modified clients or any unauthorized software that interacts with Mythria or gives you an unfair advantage;
- exploit bugs, glitches or design mistakes instead of reporting them to us;
- buy, sell or trade accounts, characters, gold, items, Mythria Points, invitation codes or services such as leveling for real money or anything else outside the game, or advertise doing so (“real-money trading”);
- harass, threaten or abuse anyone, or post content that’s illegal, hateful or sexually explicit, or that infringes someone else’s rights;
- impersonate us, our staff or anyone else;
- access, or try to access, accounts, systems or data you’re not allowed to, or get around access controls such as invitations, bans and update checks;
- attack, overload or disrupt our servers or networks, or interfere with other players’ use of the Services;
- copy, scrape or extract the Services’ content, assets or data, including to train machine-learning models, except as these Terms or the law expressly allow; or
- use the Services for anything illegal.
7. Virtual items and Mythria Points
Mythria has things that exist only in the game, such as gold, items, unlocks and boosts, and Mythria Points, the currency you can buy and spend in the shop (together, “virtual items”).
- Virtual items are a limited license to use content in the Services. They aren’t money or personal property, have no cash value, and can’t be redeemed for money, sold, or exchanged for anything outside Mythria.
- Mythria Points belong to the account that bought or received them and can’t be moved to another account. They don’t expire while your account is open.
- You can trade gold and items with other characters only where the game allows it, and never for real money (section 6).
- We can manage, change, rebalance or remove virtual items, for example to fix bugs or balance the game, and we can correct balances that are wrong because of an error, fraud, a refund or a payment dispute.
- If we permanently shut down Mythria, we’ll give at least 60 days’ notice in the game or by email, and we’ll stop selling Mythria Points when we give it. Virtual items, including unused Mythria Points, end when the Services end, unless the law requires otherwise.
8. Purchases
- Prices and payment. Prices are shown before you buy, in U.S. dollars unless we say otherwise, and any taxes are added at checkout. Payments are processed by our payment providers under their terms, and we don’t receive your full card details. By buying, you confirm that you’re allowed to use the payment method and you authorize the charge.
- Where you can buy. Purchases may be offered only in certain countries. We may refuse or cancel an order, for example if a price was shown in error, we suspect fraud, or the order comes from somewhere we don’t sell.
- Under 18. If you’re under 18, you need a parent’s or guardian’s permission before you buy anything. Parents and guardians: you’re responsible for purchases on accounts you let your child use, so please keep your payment details out of their reach.
- Delivery. Mythria Points and items are added to your account once payment is confirmed, usually within minutes. If something you bought doesn’t arrive, contact us.
- Using what you buy. Mythria Points are spent when you confirm a purchase in the shop. Boosts such as potions and auras start when you use them and keep running while you’re offline until they end.
- Refunds. Purchases are final and non-refundable, and Mythria Points and items you’ve received or used can’t be returned, except where the law requires. If you see a charge you didn’t make, or you were charged by mistake, email us within 60 days and we’ll look into it.
- Payment disputes. If you dispute a charge with your bank or card issuer, we may remove the Mythria Points or items from that purchase, and limit further purchases on the account until the dispute is resolved. Disputing a charge won’t, by itself, stop you from signing in or playing.
9. Pre-orders and packs
Some packs, such as the Founder’s Pack, are sold before all of their contents are in the game (a “pre-order”).
- A pre-order includes the rewards described on its product page when you buy it. They’re in development and shown with concept art, so their final look and details may differ, but each will be the kind of reward described.
- Rewards are added to your Mythria account as each becomes available in the game. Some can be used only after your character reaches a level stated on the product page.
- Unless its product page says otherwise, a pre-order doesn’t include an alpha invitation or access to any test.
10. Your content and feedback
“Your content” is anything you create or send through the Services, such as character and guild names, chat, letters, reports and screenshots. You keep whatever rights you have in it.
- You give us a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to host, store, copy, display, adapt, distribute and otherwise use your content to run, improve and promote the Services, for as long as your content is in the Services or we reasonably need it for those purposes.
- You’re responsible for your content, and you promise that you have the right to share it and that it follows these Terms and the Code of Conduct.
- We may review, refuse, move or remove any content, and we may, but don’t have to, monitor chat and other activity to keep the Services safe.
- If you send us ideas, suggestions or feedback, we may use them freely without any obligation to you.
11. Videos and streams
You’re welcome to stream Mythria and to make and share videos and screenshots of your play, including on channels that earn money from ads, subscriptions or donations, as long as:
- you don’t suggest that we endorse or sponsor you, or present your content as official;
- you don’t sell or hand out our game files, art, music or other assets on their own, or use them to make another product;
- your content follows the Code of Conduct and the law; and
- you follow any extra rules we give for a particular test or event.
We may withdraw this permission for particular content.
12. Other services and links
The Services may link to or work with services we don’t control, such as payment providers, community platforms and video sites. Their own terms and privacy policies apply, and we aren’t responsible for them.
13. Privacy
Our Privacy Policy explains what information we collect, how we use it and the choices you have.
14. Suspension and termination
- We may warn or mute you, remove content or virtual items, or suspend or close your account if we reasonably believe you’ve broken these Terms or the Code of Conduct, harmed or endangered other players or us, or committed fraud, or if the law requires it. Where it’s appropriate and safe, we’ll tell you why, and you can ask us to review the decision by emailing us within 30 days.
- Virtual items, including Mythria Points, lost because of a suspension or closure for breaking these Terms won’t be refunded.
- We may change, suspend or end the Services or any part of them, with reasonable notice where we can give it (and as section 7 says for a permanent shutdown).
- Parts of these Terms that by their nature should continue, such as those about virtual items, the licenses you give us, disclaimers, limits on liability and disputes, continue after this agreement ends.
15. Disclaimers
We work hard on Mythria, but it’s an online game in development. To the fullest extent the law allows, the Services, the software and all virtual items are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don’t promise that the Services will be uninterrupted, secure or free of errors or harmful components, or that game data won’t be lost. Some places don’t allow these exclusions, so some of them may not apply to you.
16. Limits on liability
To the fullest extent the law allows:
- neither we nor our affiliates, licensors, suppliers or staff will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data, goodwill or virtual items, arising from or related to the Services or these Terms, even if we were told they were possible; and
- our total liability for all claims about the Services or these Terms is limited to the greater of what you paid us in the 12 months before the event the claim is about, or US$50.
These limits apply whatever the legal theory, and even if a remedy fails of its essential purpose. They don’t limit liability that the law doesn’t allow to be limited, such as for fraud, or for death or personal injury caused by negligence.
Indemnity. If someone makes a claim against us because you broke these Terms, the Code of Conduct or the law, or because of your content, you agree to cover our reasonable losses and costs from it, including legal fees, to the extent the law allows.
17. Disputes and arbitration
Please read this section carefully. It affects how disputes between you and us are resolved.
Talk to us first. Before starting an arbitration or court case, whoever has the dispute must send the other a written notice describing it and the relief wanted, and we’ll both try in good faith to resolve it for 60 days. Send your notice to support@mythria.online. We’ll send ours to your account’s email address.
Arbitration. If it isn’t resolved, you and we agree that any dispute, claim or controversy arising out of or relating to the Services, these Terms or any purchase will be resolved by binding individual arbitration, not in court, except as described below. The Federal Arbitration Act governs this section. The American Arbitration Association (AAA) will run the arbitration under its Consumer Arbitration Rules, available at adr.org, and fees will be paid as those rules provide. The arbitration will take place by video or phone, in writing, or in person in the county where you live. The arbitrator may award the same individual relief a court could, but only to you individually and only as far as your claim needs.
Exceptions. Either of us may instead bring an individual claim in small-claims court if it qualifies. Either of us may also ask a court to stop the infringement or misuse of intellectual property, or unauthorized access to the Services.
No class actions or jury trials. You and we may bring disputes only individually, not as a plaintiff or class member in any class, collective, consolidated or representative proceeding, and an arbitrator can’t combine more than one person’s claims. You and we both waive any right to a jury trial. If a court decides this paragraph can’t be enforced for a particular claim, that claim alone must be decided in court, after any individual arbitration is finished.
Many similar claims. If 25 or more similar demands for arbitration are filed against us, or by us, by the same or coordinated lawyers or organizations, they’ll be administered in batches of up to 25, with one arbitrator for each batch, and the remaining demands will wait until each batch is decided. Fees will be charged per batch where the AAA’s rules allow.
Opting out. You can opt out of this arbitration agreement within 30 days after you first accept these Terms. Email support@mythria.online from your account’s email address, with your name and a clear statement that you want to opt out. Opting out doesn’t affect the rest of these Terms.
Time limit. To the extent the law allows, a dispute must be started within one year after it arose, or it’s permanently barred.
Changes. If we change this section, the change won’t apply to a dispute we already knew about, and you can reject it by emailing us within 30 days after it takes effect.
18. Governing law and courts
These Terms are governed by the laws of the State of Washington and applicable U.S. federal law, without regard to conflict-of-law rules. For any dispute that isn’t arbitrated, you and we agree to the exclusive jurisdiction of the state and federal courts in Snohomish County, Washington, except that you may bring a claim in small-claims court where you live.
19. Changes to these Terms
We may update these Terms. If a change is significant, we’ll tell you in advance by email, in the launcher or in the game, and ask you to accept the new Terms when you next sign in. If you don’t accept them, you can stop using the Services and close your account. The date at the top of this page shows when the Terms last changed.
20. General
- These Terms and the documents they include are the entire agreement between you and us about the Services, and they replace any earlier agreements about them.
- If any part of these Terms is found unenforceable, the rest stays in effect.
- If we don’t enforce part of these Terms right away, we can still enforce it later.
- You may not assign or transfer these Terms. We may assign them, for example as part of a merger, acquisition or sale of assets.
- We aren’t responsible for delays or failures caused by events beyond our reasonable control.
- You agree to receive notices and agreements from us electronically, by email or through the Services.
- You must follow U.S. export control and sanctions laws when using the Services.
